STATE COAL MINES (AMENDMENT) ACT.

Act No. 4, 1967.

An Act to make further provision with respect to the granting of permissive occupancies of certain land pursuant to the State Coal Mines Act, 1912, as amended by subsequent Acts; for this purpose to amend that Act, as so amended; and for purposes connected therewith. [Assented to, 14th March, 1967.]

BE	it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as
follows: —

1.      (1) This Act may be cited as the "State Coal Mines

(2) The State Coal Mines Act, 1912, as amended by subsequent Acts and by this Act, may be cited as the State Coal Mines Act, 1912-1967.

2.      (1) The State Coal Mines Act, 1912, as amended by

subsequent Acts, is amended—

(a)	(i)	by omitting from subsection one of section 12A the words "parts of the land" and by inserting in lieu thereof the words "parts of such Crown lands as are within the land";
(ii)	by omitting from paragraph (b) of subsection six of the same section the words "1950-1951, in respect of coal produced by such person at the Oakdale State Coal Mine" and by inserting in lieu thereof the words "1950, as amended by subsequent Acts, in respect of coal pro­ duced by such person from land being worked under such permissive occupancy";

(b) by omitting the First Schedule and by inserting in lieu thereof the following Schedule : —

FIRST S C H E D U L E .

All those pieces or parcels of land within the parishes of Burra- gorang and Werriberri, County of Camden, Land District of Picton, Wollondilly Shire, having an area of about 9595 acres being the lands within the following boundaries:—

Commencing at the south western corner of portion ML3, Parish of Burragorang; and bounded thence by portions ML8, ML2 and 37, Parish of Burragorang to the south western corner of portion ML4, Parish of Werriberri; thence by the western boundaries of that portion and of portions ML1 and ML8 to the

south western corner of portion 50, Parish of Werriberri; by
that portion, portions 101, 11, 42 and 4 to a point due west of

the north western corner of portion ML10, Parish of Werri­ berri ; by a line, the northern and an eastern boundary of that portion, part of the northern and part of the eastern boundaries of portion ML11 and the northern and eastern boundaries of por­ tion ML12 to the northern boundary of portion 54, Parish of Werriberri; by that portion, portions 53, 52, 51 and 57, Parish of Werriberri, part of the western boundary of Reserve 51,860 from sale for quarry notified 24th November, 1916, and por­ tions 154, 42 and 84, Parish of Burragorang, thence by the eastern and southern boundaries of portion 6, part of the eastern

boundary of portion 13 bearing 180 degrees 17 minutes for 22 chains 89.1 links thence by a line bearing 2 7 0 degrees for 85 chains 84 links to the south eastern corner of portion ML4, thence by the southern boundaries of that portion and portion ML3 to the point of commencement.

(2) The proclamation of the twenty-fourth day of May, one thousand nine hundred and forty-five, made under subsection one of section two of the State Coal Mines Act, 1912, as amended by subsequent Acts, and published in Gazette Number fifty-five of the first day of June, one thousand nine hundred and forty-five, is hereby revoked in so far as it relates to any of the land described in the First Schedule to the State Coal Mines Act, 1912, as amended by subsequent Acts and by this Act.

3. Any permissive occupancy granted under section 12A of the State Coal Mines Act, 1912, as amended by subsequent Acts, and in force immediately before the commencement of this Act shall not cease to be in force by reason only of any amendment made by subsection one of section two of this Act.
