THOMAS FREDERICK BATHURST, Lieutenant-Governor I, the Honourable Thomas Frederick Bathurst, Lieutenant-Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 46 of the State Authorities Superannuation Act 1987, make the following Order.

Explanatory note
The object of this Order is to include Port of Newcastle Operations Pty Limited (as trustee of the Port of Newcastle Unit Trust) in the list of employers in Schedule 1 to the State Authorities Superannuation Act 1987. This will mean that certain employees of Newcastle Port Corporation whose employment is transferred to that company will continue to be contributors for the purposes of the Act.
This Order is made under section 46 of the State Authorities Superannuation Act 1987.

1      Name of Order

This Order is the State Authorities Superannuation Amendment (Port of Newcastle
Operations) Order 2014.

2      Commencement

This Order commences on 30 May 2014 and is required to be published on the NSW legislation website.

Schedule 1 Employers

Insert at the end of Part 1:

Port of Newcastle Operations Pty Limited (as trustee of the Port of Newcastle Unit Trust), limited to those employees whose employment is transferred from Newcastle Port Corporation to Port of Newcastle Operations Pty Limited (as trustee of the Port of Newcastle Unit Trust) by order under section 16 of the Ports Assets (Authorised Transactions) Act 2012.
