Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the State Authorities Superannuation Act 1987.

Explanatory note
The Crown Employees (Police Officers Death and Disability) Award 2005 makes provision for the payment of death or incapacity benefits to or in respect of a police officer to which it applies. The award makes provision for coverage for death and or permanent disability benefits for contributors to the State Authorities Superannuation Scheme who relinquish their coverage for the additional benefit under that Scheme.
The objects of this Regulation are:
| (a) | to allow the SAS Trustee Corporation to provide to NSW Police or the FSS Trustee Corporation information that it obtains about an employee in the administration of the State Authorities Superannuation Act 1987 (but only with the consent of the employee and for the purposes of complying with or giving effect to the award), and |
| (b) | to provide for the relinquishment of coverage for the additional benefit by certain police officers, and |
| (c) | to remove a redundant definition from provisions relating to a firefighters award. |
This Regulation is made under the State Authorities Superannuation Act 1987, including sections 46AF, 46AI, 46AK and 55 (the general regulation-making power).

1 Name of Regulation
This Regulation is the State Authorities Superannuation Amendment
(Police Officers) Regulation 2006.
2 Commencement
This Regulation commences on 30 January 2006.
3 Amendment of State Authorities Superannuation Regulation 2005
The State Authorities Superannuation Regulation 2005 is amended as set out in Schedule 1.

Omit the definition of retained firefighter.

Insert after Part 4:
Part 4A Police officers award
30A Definitions In this Part:
2005 police officers award means the Crown Employees (Police
Officers Death and Disability) Award 2005.FTC means the FSS Trustee Corporation.
30B Prescription of police officers award For the purposes of the definition of police officers award in section 46AI of the Act, the 2005 police officers award is prescribed.
30C Provision of information For the purposes of complying with or giving effect to the 2005 police officers award, and only with the consent of the relevant employee, STC may provide to NSW Police or the FTC information about the employee obtained in the administration of the Act.
30D Existing police officers may no longer apply for cover for
additional benefit
(1)
This clause applies to an employee who was a police officer on 30 January 2006 and who had not, before that date, had an application for additional benefit cover approved under section 22 of the Act.

30E Existing police officers who elect to relinquish cover for additional
benefit
(1)
This clause applies to a person who was a police officer on 30 January 2006 and who elects to relinquish cover for the additional benefit on or before 31 March 2006.
(2) Despite section 22 of the Act, if this clause applies:
(a)
the police officer ceases to be liable to pay the additional benefit levy in relation to any subsequent period during which the police officer is not covered, and
(b)
STC must effect the cessation of the additional benefit cover of the person on and from 31 March 2006, and
(c)
the police officer is not entitled to be covered for the additional benefit while employed as a police officer.
30F New police officer employees covered for additional benefit
(1) This clause applies to an employee who was not a police officer immediately before 30 January 2006 and who had not had an application for additional benefit cover approved under section 22 of the Act at the time of commencing employment as a police officer.
