(Relating to the benefits payable to certain former Sydney County Council
employees who retired on reaching 55 years of age)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the State Authorities Superannuation Act 1987, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation is taken to have commenced on 12 April 1990.
Amendment
2. The State Authorities Superannuation (Closed Local Government Schemes Transfer) Regulation 1990 is amended by inserting at the end of clause 24 the following subclause:
(2) The Board must also pay the amount of the supplementary benefit to an employee to whom this Part applies if the employee, having reached 55 but not having reached 58 years of age, has retired from the service of the Sydney County Council before 2 January 1991, or from the service of Sydney Electricity on or after that date, and the Board is satisfied that the employee:
(a)
was employed by the Sydney County Council on 31 March 1977 and continued until retirement to be employed by that Council and, where appropriate, by Sydney Electricity; and

| (b) | was continuously a contributor to the Benefits Fund from and including 31 March 1977 to the transfer day; and |
| (c) | was continuously a contributor to the SAS Fund from and including the transfer day to and including the date of retirement. |
EXPLANATORY NOTE
The purpose of thls Regulation is to amend the State Authorities Superannuation (Closed Local Government Schemes Transfer) Regulation 1990 so as to confer on former employees of the Sydney County Council or Sydney Electricity an entitlement to receive a supplementary benefit payment under clause 24 of the Principal Regulation if, having retired on or after reaching 55 but before reaching 58 years of age, they:
• were employed by Sydney County Council on 31 March 1977 and continued until retirement to be employed by that Council and, where appropriate, by Sydney Electricity;
• continuously contributed to the Superannuation Benefits Fund established under the Local Government and Other Authorities (Superannuation) Act 1927 from and including that date to the date on which they became contributors to the State Authorities Superannuation Fund; and
• continuously contributed to the latter Fund until the date of retirement.
The Regulation is taken to have commenced on 12 April 1990, the date on which
the Principal Regulation commenced. The authority for making the operation of the
Regulation retrospective is clause 2 of Schedule 4 to the State Authorities
Superannuation Act 1987.
(Note: The staff of Sydney County Council were transferred to Sydney
Electricity on 2 January 1991.)
