1995—No. 226

EXPLANATORY NOTE

Under the State Authorities Superannuation Act 1987, employers within the meaning of the Act are required to make superannuation contributions to the State Authorities Superannuation Fund in respect of certain of their employees. Schedule 1 to the Act lists organisations and bodies that are employers for the purposes of the Act. Section 46 of the Act authorises the Governor-in-Council, by order, to amend the Schedule by inserting the name of a corporation. Section 46AA of the Act authorises the Governor- in-Council, by order, to omit the name of an employer if the removal is a consequence of a Government privatisation initiative affecting the employer.

The purposes of this Order are:

• to include three irrigation corporations—Jemalong Wyldes Plains Irrigation Limited, Lower Murray Irrigation Areas Limited and Murray Irrigation Limited—in the list of employers. These irrigation corporations became State owned corporations (under the State Owned Corporations Act 1989) on 24 February 1995; and

• to remove the names of the same three irrigation corporations from the list of employers, effective one week later. The corporations were privatised (under the Irrigation Corporations Act 1994) on 3 March 1995.

The effect of the Order is to require the named employers to make contributions in respect of their employees for the period between 24 February 1995 and 3 March 1995. (Sections 46AA (2) and 46 (2) of the Act authorise an Order to be made so that it has effect on and from a date that is earlier than the date of its publication)
