ORDER

NEW SOUTH WALES

I, Rear Admiral PETER ROSS SINCLAIR, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 46 of the State Authorities Superannuation Act 1987, do, by this my Order, amend Schedule 2 to that Act (Excluded persons), with effect on and from 16 August 1992, by inserting after clause 2 of that Schedule the following clause:

Exclusion on and from 16 August 1992

3. (1) For the purposes of the definition of “employee” in section 3

(1), a person is an excluded person unless he or she:

(a) is a contributor on 16 August 1992; or

(b) had lodged with the Board, before 16 August 1992, an election to contribute to the Fund which takes effect on or after that date.

(2) For the purposes of this clause, an application that was sent to the Board, by post or otherwise, before 16 August 1992 is taken to have been lodged with the Board before 16 August 1992.

(3) This clause ceases to have effect on 1 January 1993 if the class of persons excluded from becoming contributors only because of this clause are not entitled by that date to become contributors to a superannuation scheme under which superannuation or retirement benefits are provided by an employer.
