I, the Honourable Thomas Frederick Bathurst AC, Lieutenant-Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 27 of the State Authorities Non-contributory Superannuation Act 1987, make the following Order.

Explanatory note
The object of this Order is to include Keolis Downer Hunter Pty Ltd in the list of employers in Schedule 1 to the State Authorities Non-contributory Superannuation Act 1987. This will mean that persons:

(a) who, immediately before 1 July 2017, were employees employed in the State Transit Authority

Group or Transport for NSW Group of the Transport Service to work in the Newcastle Buses or

Newcastle Ferry operations (but excluding those employed in the Transport Senior Service at those operations), and

(b)	whose employment was transferred to Keolis Downer Hunter Pty Ltd on that date pursuant to offers
of employment made under the Transitional Agreement between the Secretary of the Department of Transport (on behalf of the State) and Keolis Downer Hunter Pty Ltd,

will continue to be employees for the purposes of the Act.
This Order is made under section 27 of the State Authorities Non-contributory Superannuation Act 1987.

1      Name of Order

This Order is the State Authorities Non-contributory Superannuation Amendment
(Keolis Downer Hunter Pty Ltd) Order 2017.

2      Commencement

This Order is taken to have commenced on 1 July 2017 and is required to be published on the NSW legislation website.

Insert at the end of Part 1:

Keolis Downer Hunter Pty Ltd (limited to those persons who, immediately before 1 July 2017, were employees for the purposes of this Act and whose employment was transferred to Keolis Downer Hunter Pty Ltd on that date pursuant to offers of employment made under the Transitional Agreement between the Secretary of the Department of Transport (on behalf of the State) and Keolis Downer Hunter Pty Ltd)
