STATE AUTHORITIES NON-CONTRIBUTORY SUPERANNUATION ACT 1987—REGULATION

(Relating to employer contributions for irregular employees)

HIS Excellency the Governor, with the advice of the Executive Council, has, on the certificate of the Minister for Industrial Relations and Minister for Further Education, Training and Employment under section 34 (2) of the State Authorities Non-contributory Superannuation Act 1987 and in pursuance of that Act, been pleased to make the Regulation set forth hereunder.

The State Authorities Non-contributory Superannuation Regulation 1988 is amended by omitting clause 6 and by inserting instead the following clause:

Irregular ernployees—employer contributions

6. (1) An employer listed in Part 1 of Schedule 1 to the Act must pay to the Board in respect of each irregular employee employed by the employer during a relevant period an amount equal to a percentage of the salary payable to that employee by the employer in respect of that period, being a percentage determined in relation to the employer by the Board with the concurrence of the Treasurer.

(2) An employer listed in Part 2 of Schedule 1 to the Act must pay to the Board in respect of each irregular employee employed by the employer during a relevant period an amount equal to 2.5 per cent of the salary payable to that employee by the employer in respect of that period.

(3) An employer listed in Part 3 of Schedule 1 to the Act must pay to the Board in respect of each irregular employee employed by the employer during a relevant period an amount equal to a percentage of the salary payable to that employee by the employer in respect of that period, being a percentage determined in relation to the employer by the Board with the concurrence of the Treasurer.

(4) An amount payable under this clause must be paid in such manner as the Board determines.

EXPLANATORY NOTE

The object of this Regulation is to change the employer funding arrangements for irregular employees under the State Authorities Non-contributory Superannuation Scheme. The amendment will bring funding for irregular employees into line with funding for regular employees under the Act (i.e. contributions calculated as a percentage of salary paid to irregular employees rather than as a percentage of the average salary of all contributors to the State Authorities Superannuation Fund as at present).
