Amendment (Affordable Rental Housing) Order 2009

under the

Environmental Planning and Assessment Act 1979

1      Name of Order

This Order is Standard Instrument (Local Environmental Plans)

Amendment (Affordable Rental Housing) Order 2009.

2      Commencement

This Order commences on the day on which it is published on the NSW legislation website.

3 Amendment of standard instrument prescribed by the Standard Instrument (Local Environmental Plans) Order 2006

(1)

Part 2 Permitted or prohibited development

Insert “Boarding houses;” before “Dwelling houses” in item 3 of the matter relating to Zone R2 Low Density Residential in the Land Use Table.

(2)

Part 2, Land Use Table

Insert “Boarding houses;” before “Child care centres” in item 3 of the matter relating to Zone R4 High Density Residential.

(3)

Part 2, Land Use Table

Insert “Boarding houses;” before “Business premises” wherever occurring in item 3 of the matter relating to Zones B1 Neighbourhood Centre and B2 Local Centre.

Dictionary

Omit “generally has shared facilities, such as a communal” from paragraph (c) of the definition of boarding house.

Insert instead “may have shared facilities, such as a communal living room,”.

(5)

Dictionary, definition of “boarding house”

Insert “, some or all of which may have private kitchen and bathroom facilities,” after “rooms” in paragraph (d).
