s1 2 s3 Standard Building Amendment (No. 1) No. 169, 1998 ˙ Short title 1. This regulation may be cited as the Standard Building Amendment Regulation (No. 1) 1998 . ˙ Regulation amended 2. This regulation amends the Standard Building Regulation 1993 . ˙ Amendment of s 129 (Liability insurance and insurance bonds for private certifiers) 3.(1) Section 129— insert— ‘ (2A) Despite subsection (2)(g), professional indemnity insurance does not fail to be in compliance with subsection (2) merely because, under the insurance, the run-off cover may cease— (a) for insurance provided in the context of a scheme of professional indemnity insurance covering private certifiers—if insurance stops being provided under the scheme on or after the next anniversary of the start of the scheme; or (b) if the insurer stops carrying on the business of providing professional indemnity insurance for private certifiers—no earlier than the next anniversary of the insurance that happens after the insurer stops carrying on the business of providing the insurance; or (c) on or after the day the insurance is lawfully cancelled; or (d) on or after the day the insurer stops trading as an insurer. ‘ (2B) However, for subsection (2A)(a) or (b) to apply, the professional indemnity insurance must also state that— (a) the insurer must give both the private certifier and the accrediting body for the private certifier at least 3 months notice of when the cessation of the run-off cover will come into effect; and (b) cessation of run-off cover does not come into effect if the notices under paragraph (a) are not given.’.
s3 3 s3 Standard Building Amendment (No. 1) No. 169, 1998 (2) Section 129, at the end— insert— ‘ (8) In subsection (2A)(b)— “anniversary” , of insurance, means an anniversary of the first taking out of the insurance. ‘ (9) In subsection (2B)(a)— “private certifier” means a person who holds or has held professional indemnity insurance provided by the insurer that has a run-off cover that is effective at the time the notice of cessation is given.’.
