2 Standard Building Amendment (No. 1) No. 98, 1994 ˙ Short title 1. This by-law may be cited as the Standard Building Amendment By-law (No. 1) 1994 . ˙ Commencement 2. This by-law commences on 26 March 1994. ˙ By-law amended 3. This by-law amends the Standard Building By-laws 1991 . ˙ Replacement of s 1.1 (Title) 4. Section 1.1— omit, insert— ˙ ‘Short title ‘1.1. This regulation may be cited as the Standard Building Law . ’. ˙ Amendment of s 1.3 (Interpretation) 5.(1) Section 1.3(1) (definitions “Act” and “Certificate of Accreditation” )— omit. (2) Section 1.3(1)— insert— ‘ “CSIRO” means the Commonwealth Scientific and Industrial Research Organization; ’. (3) Section 1.3(1) (definition “Building Code of Australia” )— omit ‘ Australian Uniform Building Regulation Co-ordinating Council ’, insert ‘ Australian Building Codes Board ’.

Section 1.4(2)— omit ‘ Australian Uniform Building Regulations Co-ordinating Council ’, insert ‘ Australian Building Codes Board ’. ˙ Amendment of s 1.7 (Certificate of accreditation) 7.(1) Section 1.7 (heading)— omit, insert— ‘Certificate of accreditation or registration’. (2) Section 1.7— omit ‘ certificate of accreditation ’, insert ‘ recognised certificate ’. (3) Section 1.7— insert— ‘(2) In this section— “recognised certificate” means— (a) a certificate of accreditation issued by the Australian Building Codes Board; or (b) a certificate of accreditation issued under section 12.9 (Director to issue certificate); or (c) a certificate of product registration issued by CSIRO; or (d) a certificate of registration issued under Part 13 before 26 March 1994. ’. ˙ Omission of s 2.8 (Responsible design) 8. Section 2.8— omit.
4 Standard Building Amendment (No. 1) No. 98, 1994 ˙ Replacement of s 2.16 (Variation of workplace areas) 9. Section 2.16— omit, insert— ˙ ‘Advice of referral agency ‘2.16.(1) This section applies if— (a) an application is made to a local government for approval to carry out building work; and (b) this by-law requires the local government to refer the application (or a part of the application) to another entity (the “referral agency” ) to assess whether the application meets specified requirements. ‘(2) However, this section does not apply if the assessment is to be made by the Commissioner of Fire Service. ‘(3) The local government must give to the referral agency, within 14 days after receiving the application, all information received with the application that is relevant to the assessment to be made by the referral agency. ‘(4) Within 21 days after receiving the information, the referral agency must give to the local government a written assessment stating— (a) whether it considers the application meets the relevant requirements; and (b) if it considers the application does not meet the requirements—the reasons for its assessment. ’. ˙ Amendment of s 9.9 (Local authority may decide the application of this Part) 10.(1) Section 9.9(2)(a)— omit ‘ resolve ’, insert ‘ decide ’. (2) Section 9.9(2)(b)— omit, insert —

(3) Section 9.9(4)— omit ‘ resolution ’, insert ‘ decision ’. ˙ Replacement of s 13.1 (Purpose) 11. Section 13.1— omit, insert— ˙ ‘Saving of registration ‘13.1. A building product that was registered under this Part immediately before the commencement of this section continues to be registered, but only until— (a) the registration is cancelled by the Director; or (b) a certificate of product registration is issued for the building product by CSIRO; or (c) 31 December 1994; whichever happens first. ’. ˙ Omission of ss 13.4–13.7 12. Sections 13.4 to 13.7— omit . ˙ Amendment of s 13.8 (Register) 13. Section 13.8(1)— omit ‘ and is to assign to each product a registration number ’. ˙ Omission of s 13.10 (Director to issue certificate) 14. Section 13.10—
