STAMP AMENDMENT REGULATIONS (NO. 2) 1994

Made by His Excellency the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Stamp Amendment Regulations

(No. 2) 1994.

and

Regulation 19 amended

2.      Regulation 19 of the Stamp Regulations 1979* is amended — (a) in subregulation (1) —

(i)      in paragraph (f), by deleting "regulation 3; and" and substituting the following —

regulation 3 or a permitted person, but only in respect of the class of instrument for which he has received permission under section 112V (3);

(ii)     in paragraph (g), by deleting "regulation 3." and substituting the following —

(iii) by inserting after paragraph (g) the following paragraph —

(h) to assess eligibility for, and (where appropriate) to allow, an exemption under section 75C may be exercised by any officer referred to in regulation 3 or a permitted person, but only in respect of the class of instrument for which he has received permission under section 112V (3).

and

(b) by inserting after subregulation (2) the following

(3) In subregulation (1) "permitted person" means a person who has received permission under section 112V to pay duty on instruments of conveyance or transfer of property by way of return. PP
