AN ACT to amend the Stamp Act, 1921.

B E it enacted by the King's Most Excellent Majesty, byCouncil and Legislative Assembly of Western Australia, inmill with the advice and consent of the Legislative

the same, as follows:—

Short title.

1.

This Act may be cited as the Stamp Act Amendment

Act (No. 3), 1930, and shall be read as one with the Stamp

Act, 1921, hereinafter referred to as the principal Act.

Amendment 'of

The Second Schedule to the principal Act is amended by deleting the item commencing with the words "Convey- ance or transfer on sale of property," and by inserting in lieu thereof an item as follows:

Conveyance or transfer on sale of property

(1) Land transfer under the Transfer of Land

Act, 1893-

(a)

in the case of a consent to an application whereby the consenting party relin- quishes any estate or interest -for valu- able consideration; and

(b)

in the ease of an application to bring land under the Act by any person who has purchased such land without having paid the duty in respect of a convey- ance or transfer thereof to him; and

(c) in the case of a transfer of laud on a sale thereof, where the amount or value of the consideration—

(2.) Any discharge of a mortgage of land under the Transfer of Land Act, 1893, executed for the purpose of enabling a substituted mortgage to he registered after the registration in priority thereto of a mortgage to the Agricultural Bank of Western Australia.

(3.)

Any substituted mortgage intended to be so regis-

tered as aforesaid.

Repeal.

4. The Stamp Act Amendment Act, 1929, is hereby re-

pealed.

Ru pri ut. 5. Copies of the principal Act hereafter printed by the

Government Printer shall be printed as amended by this Act and by all other prior Acts amending the principal Act under the superintendence of the Clerk of Parliaments, and refer- ences to the amending Acts shall be made in the margin. In such reprints of the principal Act the sections may be TO- numbered in arithmetical order, and cross-references ad- justed, and the short title shall be the Stamp Art, 1921-1930.
