266 ANNO VICESIMO QUINTO ELIZABETHAE SECUNDAE REGINAE No. 30 of 1976 An Act to amend the StampAct 1894-1975 in certain particulars [ASSENTED TO 28TH APRIL, 1976] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows- 1. Short title and citation . (1) This Act may be cited as the Stamp Act Amendment Act 1976. (2) In this Act the Stamp Act1894-1975 is referred to as the Principal Act.

Stamp Act Amendment Act 1976, No. 30 267 (3) The Principal Act as amended by this Act may be cited as the Stamp Act1894-1976. 2. Application of Principal Act as amended . The Principal Act as amended by this Act shall apply in respect of any billing period (as defined by the Principal Act as so amended) that terminates in the month of April 1976 and in respect of every such billing period that terminates in any month thereafter. 3. Amendment of s. 42B. Section 42B of the Principal Act is amended by- (a) in subsection (1)- (i) omitting the definition " active account " and substituting the following definition:- " " active account " means an account kept by a cardholder's bank • for a cardholder on whose account the cardholder's bank has, during the billing period specified in subsection (3), made a payment pursuant to an obligation accepted by it upon the issue of a credit card to or at the direction of the cardholder;"; (ii) omitting the definition " billing period " and substituting the following definition:- " " billing period " means a period in relation to which a statement of account or of transactions is issued to a cardholder or to any other person with a view to recoupment of the cardholder's bank in respect of payments made by it pursuant to an obligation accepted by it upon the issue of a credit card to or at the direction of the cardholder;"; (iii) omitting the definition "cardholder" and substituting the following definition:- " " cardholder " means a person ordinarily resident in Queensland for whom a cardholder's bank keeps an account in connexion with which there may be made payment pursuant to an obligation accepted by the cardholder's bank upon the issue of a credit card to or at the direction of that person;"; (iv) omitting the definition " cardholder's bank " and substituting the following definition:- " " cardholder's bank " means the person which or who has issued a credit card and in the ordinary course of business may make payment pursuant to an obligation accepted by it or him upon the issue of the credit card;";

268 Stamp Act Amendment Act 1976, No. 30 (v) omitting the definition " credit card " and substituting the following definition:- " " credit card " means a card or other writing (by whatever name called) such that in respect of transactions in connexion with which the card or other writing is produced any person, whether the cardholder's bank or not, agrees, whether subject to conditions or not, to make payment to a merchant;"; (b) in subsection (4), omitting the words " bank or financier " and substituting the words " cardholder's bank ".
