AN ACT to amend the Stamp Act, 1921-1954.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation. 1. (1) This Act may be cited as the Stamp Act Amendment Act, 1957.

(2) In this Act the Stamp Act, 1921-1954,

Act No. 10 of 1922 as reprinted with amendments '39_

to and including Act No. 11 of 1950 incorporated approved for num, Val. 5.

pursuant to the provisions of the Amendments tgoA	.April,
Incorporation Act, 1938 and as further amended by Acts Nos. 5 and 63 of 1954,

is referred to as the principal Act.

(3) The principal Act as amended by this Act

may be cited as the Stamp Act, 1921-1957.

2.    This Act shall come into operation on a day 2fer ems-

to be fixed by proclamation.

3. Section fifty-two of the principal Act is amended.

amended by adding after subsection (3) the follow-

ing subsection:

(4) Where by amendment of this Act the ad valorem duty on cheques is increased, if at the day when the amendment comes into operation, unused cheque forms on which is denoted by printing or by impressed stamps the ad valorem duty on bills of exchange at the rate prescribed prior to that day

(a)	are in the possession of a banker, the increase in the duty shall be deemed on and after that day to be denoted by printing or by impressed stamps on those forms and the banker shall as and when required by the Commissioner account for and pay to the Commis- sioner the amount of the increase; or
(b)	are in the possession of a person not being a banker, the forms shall not be used unless the increase is denoted on them by impressed stamps, or by adhesive stamps attached to them and duly cancelled.

Section fifty-four of the principal Act is

amended by substituting for the word, "twopence"

in line one, the words, "three pence".

Section fifty-eight of the principal Act is amended by substituting for the words, "two pence" in line five of subsection (3), the words, "three pence".

The Second Schedule to the principal Act is amended by substituting for the figure, "2" denoting two pence under the column headed, "Stamp DutyPayable"

Schedule 6.

(a) opposite the word "demand" being the last word in the item headed, "BILL OF

EXCHANGE OR PROMISSORY NOTE";and

(b) opposite the item headed, "CHEQUE or

ORDER payable on demand";

the figure, "3", to denote three pence.
