THE STALLIONS [ASSENTED TO 29TH NOVEMBER, 1934.] REGISATCRTASTION AMENDMENT B E it enacted by the King's :Most Excellent Majesty, ACT OF 1934. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Stallions Short titlo Registration Acts Amendment Act of 1934," and shall be and . read as one with *" The Stallions Registration Acts, 1923 constl'uctlOn. to 1932," herein referred to as the Principal Act. . In section two of the Principal Act the definition of 8.2. of " Stallion" is repealed, and the following definition is inserted in lieu thereof :- Stallion. " "Stallion"-Any entire male horse of the age of three years or over such age." Aofmse. 6nd. ment follow 3 s . : S-ection six of the Principal Act is amended, as (a) In subsection one the words" of all his stallions'l are repealed and the words " of his stallions for the year next ensuing" are inserted in lieu thereof. (b) The following words are added to the said subsection one, as follows : - " Such application for registration shall also be made in respect of any entire horse which will become a stallion on the first day of August next following: Provided that it shall not be necessary for any owner to make any such application in respect of any entire blood or trotting horse or any blood or trotting stallion whose age will not exceed four years on the first day of August next following, and which horse or stallion, as the case may be, is not used or offered for stud purposes; but an owner if he so desires may make application for registration in respect of any such entire blood or trotting horse or such blood or trotting stallion as referred to in this proviso." (c) The following new subsection (lA) is inserted after subsection one, as follows :- " (lA.) For the purpose of computing the age of any entire horse or stallion every entire horse or stallion foaled in any year as defined in this Act shall be deemed to have been foaled on the first day of such year." (d) Subsection six is amended by inserting after the words" for renewal," in the first paragraph thereof, the words "shall be and become due, payable, and recoverable upon the due date of application for registration or renewal, as the case may be, and" ; also in the second paragraph, after the words" shall be payable," the words "on or before the last day of August in each year " are inserted. Any person contravening the provisions of this section shall be liable to a penalty of not less than twenty pounds and not exceeding one hundred pounds." 6. The following additional paragraph (al) is Amendment inserted in subsection three of section eleven of the of s. ll. Principal Act, namely:- "(a1) Neglects or fails to pay any fee due and payable under this Act within the prescribed time." 7. Section twelve is repealed and the following Repeal of new section twelve is inserted in lieu thereof, namely : - ~t2~ew " [12.] (1.) All penalties imposed for any breach of Recovery of this Act or the Regulations may be recovered in a penalties. summary way on complaint under *" The Justices Acts, 1886 to 1932.'.' A prosecution for any of the offences under this Act may be instituted within twelve months after the offence is committed or within six months after the discovery of the offence, whichever is the later period. (2.) All fees and other moneys due and payable under this Act or the Regulations may be recovered in a summary way on complaint under *" The Justices Acts, 1886 to 1932," or by action in any court of competent jurisdiction. All complaints for the recovery of such fees and other moneys may be m de within twelve months after the same became due an payable, or within six months after the discovery of the failure to pay same, whichever is the later period. * 50 Vie.
