Stage Carriages in New South Wales" A n d whereas it is expedient to ex tend the provisions of the said reci ted Act and to pun i sh crimi­ nally coachmen or o ther persons dr iv ing s tage coaches or o ther public

carr iages car ry ing passengers for h i re for accidents occasioned by t h e careless or furious dr iv ing or o ther wilful misconduct of such coach­ men or o ther persons hereinafter ment ioned Be i t therefore enacted by H i s Excel lency t h e Governor of N e w South Wales wi th t he advice and consent of t h e Legislat ive Counci l thereof T h a t if any person whatever shall be m a i m e d or otherwise injured by reason of t h e care­ less or furious dr iv ing or of the rac ing or o ther wilful misconduct of any coachman or o ther person dr iv ing any s tage coach or o ther publ ic carr iage ca r ry ing passengers for h i re such careless or furious dr iv ing or rac ing or other wilful misconduct of such coachman or o ther person shal l be and the same is hereby declared to be a misdemeanor and shall be pun i shab le as such by fine and impr i sonment .

2. Provided always and be it enacted T h a t no t h ing here in con­ ta ined shall be deemed to affect the r igh t of any person to recover by action at law damages for any in jury commit ted as aforesaid.
