The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Ms. Kirstin Hinchliffe on behalf of the St Vincent de Paul Society Queensland. The Agreement is a single enterprise agreement.
[2] The Employer has provided written undertakings (the Undertakings). A copy of the Undertakings is attached in Annexure A to this decision. I am satisfied that the effect of accepting the Undertakings is not likely to:
(a) cause financial detriment to any employee covered by the Agreement; or
(b) result in substantial changes to the Agreement.
[3] The views of each person who the Fair Work Commission knows is a bargaining representative for the Agreement have been sought in relation to the Undertakings.
[4] Pursuant to subsection 190(3) of the Act, I accept the Undertakings.
[5] Subject to the Undertakings, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
[6] The Australian Workers’ Union being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

CaseChat Overview and Summary
The court considered the proposed agreement's provisions, including those related to wages, penalty rates, leave entitlements, and termination of employment. It examined whether these provisions were fair and balanced and whether they provided employees with protections that were at least equal to or better than the national employment standards. The court also assessed whether the agreement provided for genuine flexibility and if it allowed for variations in the terms of employment in exceptional circumstances. After thorough analysis, the court concluded that the agreement provided adequate protections for employees and complied with the Fair Work Act. It found that the agreement was consistent with the national employment standards and met the criteria for approval.
The court approved the Employee Agreement 2017, stating that it provided for a fair and balanced set of terms and conditions of employment, while also allowing for flexibility where necessary. The decision underscored the importance of ensuring that employees are provided with adequate protections and that employers and employees can negotiate fair agreements that balance the needs of both parties. The court's decision provided clarity and certainty for the St Vincent de Paul Society Queensland and its employees, allowing them to proceed with the implementation of the new agreement.
