An Act to enable the Churchwardens of the Parish Church of Saint J ames in the Town of Sydney to build a new Side-wall thereto at a less distance from the southern boundary- line of King-street than is allowed bv Law. [22nd October, 1839.]

i t is amongs t o ther t h ings enacted Tha t i t shall no t he lawful for any person to erect any bu i ld ing of any k i n d or descript ion whatsoever w i t h i n t h e town of Sydney wi th in twelve feet of t he ou te r curb-s tone or t h e exter ior edge of the footways in the said t o w n and whereas by reason of t h e increased popula t ion of t h e Pa r i sh of Saint J a m e s in t h e said town t h e accommodat ion afforded by t h e said Church is found to he insufficient for the n u m b e r s of persons desirous of a t t e n d i n g publ ic worship the re in and i t is desirable to ex tend t h e
same by en la rg ing t h e said Church which canno t he advantageous ly
effected wi thou t t he aid of t h e Legis la ture in consequence of t he
p rox imi ty of t h e said C h u r c h to King-s t ree t in t he said t o w n Be it therefore enacted by H i s Excel lency t h e Governor of N e w Sou th W a l e s w i t h t h e advice of t h e Legislat ive Council thereof Tha t immedia te ly from and after t h e pass ing and publ ica t ion of th i s A c t i t shall be lawful for t h e Churchwardens of t h e said C h u r c h duly appoin ted unde r t h e provisions of a n Ac t passed in t he e igh th year of t h e re ign of H i s said la te Majesty K i n g W i l l i a m t h e F o u r t h in t i tu led " An Act to regulate the temporal affairs of Churches and Chapels of " the United Church of England and Ireland in the Colony of New " South Wales" to erect a new Side-wall to t h e said C h u r c h on t h e foundat ion of t h a t p a r t of t he l ine of t he dwarf wall at p resen t enclosing the same which r u n s paral le l to t he sou the rn boundary- l ine of King-s t ree t in the said town no twi th s t and ing t h a t t he said dwarf wall be at no grea ter dis tance from t h e curb-s tone or outer edge of t he footway t h a n n ine feet any t h i n g in t h e said reci ted Act or in any
