number four intituled An Act to authorize the appropriation

of the Old Btirial Ground or Cathedral Close in Sijdneij to certain Municipal and other Bublic purposes” it was enacted amongst other things that it should he huvful for the Governor with the advice of the Executive Council to grant to the Municipal Council of Sydney that part of the land commonly called the Old Bm-ial Ground or Cathedral Close in the City of Sydney which is described in the first Schedule to the said Act on condition that a portion of the said land not being more than half an acre should he set apart for the eri'ction of a Town Hall thereon And ivhcrc'as by the fourth section of the said Act it was amongst other things further enacted that the said Municipal Council should cause the sum of tiventy-five thousand pounds at the least to he expended in building on the land so set apart as aforesaid for a Town Hall to be completed and fit for use on or before the first day of January in the year one thousand eight hundred

and seventy-two and that if the said sum should not he expended as aforesaid or the said Town Hall completed within the time so limited the said Municipal Council should be subject to a penalty of one thousand pounds monthly until the said sum sliould be so expended or the said building he completed And whereas by the Act thirty-six Victoria number twelve the period of time for the completion of the said Town Hall was extended to the first day of January one thousand eight hundred and seventy-five And whereas the said Town Hall has not been completed within the time now fixed by law for such completion althoiigh the sum of fifty thousand ]iounds has been expended thereon And whereas it is expedient to repeal so much of the said Act as provides for the recovery of penalties for the non­ completion of the said Town Hall Be it therefore enacted by the Queen’s Most Excellent Majesty by and with tlie advice and consent of the Legislative Council and Legislative Assembly of Aew South Wales in Parliament assembled and by the authority of the same as follows:—

Kepeal of sec. 4 of

1. The fourth section of the Act of Parliament thirty-two Victoria number fom* shall be and the same is hereby repealed saving and reserving all rights and claims if any noAV existing under the said section.
