Spent Convictions (Act Amendment)

Regulations 2014

Made by the Governor in Executive Council under sections 16 and 33 of the Act.

1.            Citation

These regulations are the Spent Convictions (Act Amendment)
Regulations 2014.

2.            Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2— on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.

3. Spent Convictions Act 1988 amended

These regulations amend the Spent Convictions Act 1988.

all spent convictions.

4.            Schedule 3 amended

(1) In Schedule 3 clause 1(4)(d) delete "person." and insert:
person.
(2) After Schedule 3 clause 1(11) insert:
(12) The persons specified in the Table are excepted from the

provisions of section 22 and Part 3 Division 4 in respect of

I.              A person who applies for admission to the legal profession under the Legal Profession Act 2008.

2. A person who applies to the Board for a declaration under
the Legal Profession Act 2008 section 23.
3. A person who is an Australian lawyer within the meaning
of the Legal Profession Act 2008.
4. A person who applies for registration as a locally
registered foreign lawyer under the Legal Profession
Act 2008.
5. A person who is an Australian-registered foreign lawyer
under the Legal Profession Act 2008.

(13) The exception in subclause (12) extends to —

(a) the Legal Practice Board established under the Legal Profession Act 2008 section 534; and
(b)

the Legal Profession Complaints Committee Act 2008 section 555.
