Part 1—Preliminary

1—Short title

These regulations may be cited as the Southern State Superannuation Variation Regulations 2007.

2—Commencement

These regulations will come into operation on 1 February 2007.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Southern State Superannuation Regulations 1995

4—Substitution of regulation 3A

Regulation 3A—delete the regulation and substitute:

3A—Salary sacrifice

For the purposes of the definition of prescribed person in section 15B of the Act, the following are prescribed:

(a)persons who—

(i)are employed by a recognised hospital or incorporated health centre (within the meaning of the South Australian Health Commission Act 1976); and

(ii)are active members of the Commonwealth Superannuation Scheme or the Public Sector Superannuation Scheme;

(b)Judges (within the meaning of the Judges' Pensions Act 1971).

5—Variation of regulation 6—Conditions authorised for the purposes of section 22(6)

Regulation 6—delete "additional" and substitute:

6—Variation of regulation 7—Amount of invalidity/death insurance benefits and amount of premiums

  1. Regulation 7(1)—delete "additional" and substitute:

    voluntary

  2. Regulation 7(6)—delete "additional" and substitute:

    voluntary

  3. Regulation 7(8)—delete "members of the police force" and substitute:

    police officers

7—Variation of regulation 11—Section 14(6) members

  1. Regulation 11(1)(a)—delete "old scheme" and substitute:

    PSS 1

  2. Regulation 11(1)(f)—delete "the Schedule to the Superannuation (STA Employees) Regulations 1991" and substitute:

    Schedule 1 of the Superannuation (STA Employees) Regulations 2005

8—Insertion of regulation 12

After regulation 11A insert:

12—Disability pension

For the purposes of section 33A(14) of the Act, persons who are—

(a)employed or engaged for a specified period of time; and

(b)remunerated solely by a fee, allowance or commission,

are prescribed.

9—Variation of Schedule—Invalidity/death insurance benefits

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
