His Excellency the Governor, with the advice of the Executive Council, has approved the following By-law made by the Council of the Southern Cross University under the Southern Cross University Act 1993.

Explanatory note
The object of this By-law is to amend the Southern Cross University By-law 2005 as a consequence of the Universities Legislation Amendment (Regulatory Reforms) Act 2014 which gives the Council of Southern Cross University the power to make rules about certain election procedures.

This By-law is made under the Southern Cross University Act 1993, including section 29 (the general power to make by-laws).

1      Name of By-law

This By-law is the Southern Cross University Amendment By-law 2016.

2      Commencement

This By-law commences on the day on which it is published on the NSW legislation website.

3 Amendment of Southern Cross University By-law 2005

(1) Clause 3 Definitions

Insert in alphabetical order in clause 3 (1):

election rules
means rules made by the Council for or with respect to accordance with the election rules.
matters referred to in section 30 (1A) of the Act.

(2) Clause 8 Definitions
Omit the definitions of absolute majority of votes, ballot paper, continuing candidate, determine by lot, electronic ballot, exhausted ballot paper, first preference vote, secondary vote and tally sheet.
(3) Clauses 10, 12 and 16–35
Omit the clauses.
(4) Clauses 13–15
Omit “referred to in clause 16 for the close of nominations for the election” wherever occurring.
Insert instead “for the close of nominations for the election issued in accordance with the election rules”.
