The Southern Cross Care (NSW & ACT) Enterprise Agreement 2012- 2015.

[1] Southern Cross Care (NSW & ACT) made application for approval of the Southern Cross Care (NSW & ACT) Enterprise Agreement 2012-2015 (the Agreement).

[2] The Australian Nursing Federation, New South Wales Nurses and Midwives’ Association and the Health Services Union East Branch were bargaining representatives for the Agreement.

[3] On 12 November 2012 I sent an email to the parties advising of some concerns about the notice of representational rights provided to the employees as well as some concerns about whether the Agreement passed the better off overall test.

[4] On 14 November 2012 Southern Cross Care (NSW & ACT) advised that they wished to withdraw its application for approval and that the unions supported this application.

[5] Southern Cross Care (NSW & ACT) sought that the Tribunal formally dismiss the application.

[6] I therefore dismiss the application for approval of the Agreement.
