2009-2011 SBT AUSTRALIAN NATIONAL CATCH ALLOCATION DETERMINATION
The Australian Fisheries Management Authority makes the following determination under subsection 17.2 of the Southern Bluefin Tuna Fishery Management Plan 1995.

Citation
1. This determination may be cited as the 2009-2011 SBT Australian National Catch Allocation Determination.
Commencement
This determination commences on the day after it is registered in the Federal Register of Legislative Instruments.
Interpretation
A term used in this determination that is defined for the purposes of the Southern Bluefin Tuna Fishery Management Plan 1995 has the same meaning in this determination as it has in that Plan.
Determination of Australia’s national catch allocation
Australia’s national catch allocation for Australia for the season which will commence on 1 December 2009 and which will end on 30 November 2011 is 8,030,000 kilograms.
Live Weight Values Applying to Each Part of the Season
The actual live weight value of a Statutory Fishing Right is further hereby calculated and specified for publication in this legislative instrument for the 2009-2011 season, to apply for two separate periods in the 2009-2011 season:
a.As to that part of the catch allocation being 5,265,000 kilograms divided by the number of Statutory Fishing Rights granted under subsection 15.1 of the Plan that have not ceased to have effect as set out in section 29 of the Plan on the date of this order, such that the actual live weight value calculated in that manner is 0.98884 kilograms actual live weight value for each Statutory Fishing Right to apply from 1st December 2009.
b.As to the balance of the catch allocation of 8,030,000 kilograms being 2,765,000 kilograms divided by the number of Statutory Fishing Rights granted under subsection 15.1 of the Plan that have not ceased to have effect as set out in section 29 of the Plan on the date of this order, such that the actual live weight value calculated in that manner is 0.519305 kilograms actual live weight value for each Statutory Fishing Right to apply only from 1st December 2010 making a total of 1.508145 kilograms total live weight value for each Statutory Fishing Right during the entire season.
Application of Condition
For the purpose of enforcement, the holders of all Southern Bluefin Tuna Statutory Fishing Rights may be notified by AFMA under s22(5) of the Act imposing a further condition prohibiting the use the actual live weight value prior to the time it is applicable.
