  1. Name of Temporary Order

This Temporary Order is the Southern and Eastern Scalefish and Shark Fishery (Specified Non-Quota Species) Temporary Order 2006

  1. Commencement

This Temporary Order commences on the 21st June, 2006.

Note   An order made under section 43 of the Fisheries Management Act 1991 ceases to have effect on a day specified in the order or on being cancelled by another order or at the end of 6 months after the order is made, whichever is the soonest.

  1. Definitions

In this Temporary Order

fisherymeans the Southern and Eastern Scalefish and Shark Fishery as defined in the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

quota permit means a permit granted under section 32 of the Fisheries Management Act 1991 which authorises fishing in the fishery which is subject to a condition relating to the quantity of specified non-quota species that may be taken.

specified non-quota species means a species of fish specified in an item below:

Neocyttus spp. (rough oreo)

6 Oreo smooth cascade Pseudocyttus maculatus

Note 1  Unless otherwise stated, a term used in this Temporary Order and in the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 has the same meaning in this Temporary Order as in the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

Note 2  Unless otherwise stated, a term used in this Temporary Order and in the Fisheries Management Act 1991 has the same meaning in this Temporary Order as in the Fisheries Management Act 1991.

  1. Take of specified non-quota species

A person may take specified non-quota species in the fishery only if the person is, or is acting for, the holder of a quota permit for the fishery which authorises the take of those species.
