SOUTHERN AND EASTERN SCALEFISH AND SHARK FISHERY OVERCATCH AND UNDERCATCH DETERMINATION 2017

The AUSTRALIAN FISHERIES MANAGEMENT AUTHORITY makes the following Determination pursuant to subsection 17(6)(aa) of the Fisheries Management Act 1991 under section 24 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

Citation

1.   This Determination may be cited as the Southern and Eastern Scalefish and Shark Fishery Overcatch and Undercatch Determination 2017.

Commencement

2.   This Determination commences on the day after it is registered on the Federal Register of Legislation.

Cessation

1. This Determination is repealed on 1 May 2018 unless earlier revoked. 

Interpretation

4.  (a) In this Determination, the terms ‘East’ and ‘West’ in the table in clause 5, in relation to the species ‘Deepwater shark’ mean:

(i)  East – the Gemfish eastern zone, as defined in Schedule 1, Part 3 section 1 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

(ii)  West – the Gemfish western zone, as defined in Schedule 1, Part 3 section 2 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

(b) In this Determination, the terms ‘Cascade Plateau’ and ‘Other’ in the table in clause 5, in relation to the species ‘Smooth oreo dory’ mean:

(i)  Cascade Plateau – the orange roughy Cascade Plateau zone of the fishery, as defined in clause 4 of Part 3 of Schedule 1 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

(ii)  Other – areas of the fishery outside the orange roughy Cascade Plateau zone of the fishery, as defined in clause 4 of Part 3 of Schedule 1 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.

(c) A term used in this Determination that is defined for the purposes of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 has the same meaning in this Determination as it has in that Plan.

Determination of overcatch and undercatch

5.   For the purposes of section 24 of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003, the ‘determined amount’ and ‘determined percentages’ for each quota species for the fishery for the 2017 fishing year commencing on 1 May 2017 and ending on 30 April 2018 are:
