1  Name

This instrument is the Southern and Eastern Scalefish and Shark Fishery (Closures Variation) Direction 2019.

2  Commencement

This instrument commences on the day after it is registered on the Federal Register of Legislation.

3  Authority

This instrument is made under subsection 41A(3) of the Fisheries Management Act 1991.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Southern and Eastern Scalefish and Shark Fishery (Closures) Direction No. 2 2015

1  Clause 7

Repeal the clause, substitute:

Exemption to the prohibition

  1. Clause 6 does not apply to a concession holder:

(1)          if the holder’s fishing concession is subject to a condition that no more than 25 per cent of their total pink ling (Genypterus blacodes) quota (caught or uncaught) in waters east of longitude 147° East can be retained in any fishing year; or

(2)          where AFMA has been notified by the South East Trawl Fishing Industry Association (SETFIA) that the concession holder has agreed to take a specified amount of pink ling east of longitude 147° East under management arrangements established by SETFIA.
