SOUTHERN AND EASTERN SCALEFISH AND SHARK FISHERY (Closures) DIRECTION No. 5 2013

Citation

1. This Direction may be cited as the Southern and Eastern Scalefish and Shark Fishery (Closures) Direction No. 5 2013.

Commencement

1. This Direction commences on the day after it is registered on the Federal Register of Legislative Instruments.

Cessation

3.This Direction ceases as if it was revoked on 1 December 2018 unless earlier revoked.

Interpretation

1. Terms used in this Direction that are defined for the purposes of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 (the Plan) have the same meanings in this Direction as they have in the Plan.

‘Automatic baiting equipment’ means any mechanical operation that automatically positions bait on the hooks without the need for each hook/snood to be individually clipped onto the mainline directly by hand during the setting of the gear.

All geographic coordinates contained within the schedules attached to this document are in terms of the Geocentric Datum of Australia 1994 (GDA94).

Unless otherwise stated, the lines between coordinates are geodesics.

Notes:             1.    Terms defined in the Fisheries Management Act 1991 have the same meanings in this Direction.

To whom this Direction applies

5.This Direction applies to a holder of a fishing concession in the Southern and Eastern Scalefish and Shark Fishery and to a person acting on behalf of the holder.

Direction not to engage in fishing

1. Fishing is not to be engaged in the following areas of the Southern and Eastern Scalefish and Shark Fishery:

(a)           Fishing is not to be engaged in the area described in Schedule 1:

(i)using gillnet methods; and

(ii)using hook methods if fishing under the authority of a shark hook boat statutory fishing right.

(b)Fishing is not to be engaged in using automatic baiting equipment in the area described in Schedule 2.

Revocation of previous Direction

1. This Direction revokes the Southern and Eastern Scalefish and Shark Fishery (Closures) Direction No. 3 2013 with effect from the commencement of this Direction.

SCHEDULE 1

Shark Hook and Gillnet Deepwater Closure

The area of the Shark Hook and Gillnet Deepwater Closure is that part of the AFZ contained within and bounded by a line commencing at the point on the Adjacent Area Boundary between the States of New South Wales and Victoria, off south eastern Australia, closest to the point of latitude 37º 35' 54.5" south, longitude 150º 12' 31.8" east.

Then south easterly along that Adjacent Area Boundary to its intersection with the outer limit of the AFZ, close to the point of latitude 38º 58' 17" south, longitude 153º 46' 43" east.

Then generally southerly and westerly along the outer limit of the AFZ to its intersection, south of Australia, with the Adjacent Area Boundary between the States of South Australia and Western Australia, close to the point of latitude 35º 19' 14.9" south, longitude 129º 00' 05.2" east.

Then northerly along that Adjacent Area Boundary to a point closest to latitude 33º 20’ 47.01” south, longitude 129º 00’ 05.01” east, (Point 1).

The area of the Automatic Longline Shallow Water Closure is that part of the AFZ contained within and bounded by a line commencing at the intersection of the outer limit of Coastal Waters off south eastern Australia with the Adjacent Area Boundary between the States of New South Wales and Victoria close to the point of latitude 37º 31’ 40.8” south, longitude 150º 01’ 59.08” east.

Then south easterly along that Adjacent Area Boundary to its intersection with parallel of latitude 37º 34’ 54” south, close to meridian of longitude 150º 10’ 04” east’.

Then east along that parallel of latitude to its intersection with the meridian of longitude 150º 12’ 43.08” east, (Point 1). Then, initially south westerly, along the geodesics sequentially connecting the following points:

Also included in the Automatic Longline Shallow Water Closure is the area within a circle of radius 8.1 nautical miles centred at the point of latitude 33º 09’ 51.1” south, longitude 156º 10’ 02.4” east, in the vicinity of Taupo Seamount.
