Act No. 140, 1982.
An Act to amend the South-west Tablelands Water Supply Administration Act, 1941, consequent upon the enactment of the Junee Water Supply Administration (Repeal) Act, 1982, and for certain other purposes. [Assented to, 16th December, 1982.1

South-west Tablelands Water Supply Administration {Amendment).
BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—
Short title.
1. This Act may be cited as the “South-west Tablelands Water Supply
Administration (Amendment) Act, 1982”.
Principal Act.
2. The South-west Tablelands Water Supply Administration Act, 1941,
is referred to in this Act as the Principal Act.
Amendment of Act No. 36, 1941.
3. The Principal Act is amended in the manner set forth in Schedule 1.
Transitional provision.
4. The sum required, pursuant to section 13 (2) of the Principal Act (as
in force immediately before the commencement of this Act), to be credited as soon as practicable after 1st January, 1982, to the South-west Tablelands Water Supply Renewal Reserve Account kept under that Act shall be the sum required, pursuant to section 13 (2) of the Principal Act (as amended by this Act), to be credited to that account not later than 31st December,

Amendments to the Principal Act.
(1) Section 8a—
After section 8, insert;—
Fixing price of water.
8a. Notwithstanding the provisions of section 8 or any contract made thereunder, the price to be paid for water supplied by the Administrator to any council during the period of 12 months com mencing on 1st January in any year shall be—
| (a) | the amount calculated, at the rate per kilolitre prescribed for that year, in respect of the quantity of water so supplied; or |
(b) the minimum amount prescribed for that year,
whichever amount is the greater.

After section 11 (1), insert:—
(1a) The capital debt (as at the commencement of the South west Tablelands Water Supply Administration (Amendment) Act, 1982) is increased by the amount of the capital debt referred to in section 12 of the Junee Water Supply Administration Act, 1915 (as in force immediately before the commencement of the Junee Water Supply Administration (Repeal) Act, 1982).
(3) (a) Section 13 (2 )—
Omit the subsection, insert instead:—
(2) There shall be credited to the Renewal Reserve Account not later than 31st December in each year such sum as the Treasurer may approve.

(b) Section 13 (5 )—
Omit “capital assets;”, insert instead “capital assets.”.
(c) Section 13 (5 )—
Omit the proviso.
(d) Section 13 (5a), (5b )—
After section 13 (5), insert:—
| (5a) | Notwithstanding subsection (5 ), the Minister may, with |
the approval of the Treasurer and subject to such conditions of repayment as the Treasurer may direct, authorise the expenditure of any balance to the credit of the Renewal Reserve Account (which shall be deemed to include any amounts invested pursuant to subsection (4 )) towards extending the works.
(5b ) Interest on any expenditure under subsection (5a) shall
be debited to the Working Account and credited to the Renewal
Reserve Account at such rate as the Treasurer may approve.
(e) Section 13 (6) —
Omit “such contribution or portion thereof may be allowed to remain a charge on the Working Account”, insert instead “pay ment of that contribution, or any part thereof, may be deferred for such period as the Minister may determine”.
(f) Section 13 (6 )—
Omit “Interest on the amount of the deferred contribution at a rate to be approved by the Colonial Treasurer shall be credited to the Renewal Reserve Account and debited to the Working Account for the period during which such contribution so remains a charge; provided that if any such contribution be made on or before the thirty-first day of August in the year in which it becomes payable in accordance with subsection two of this section no interest shall be credited or debited as aforesaid.”.

(g) Section 13 (7 )—
After section 13 (6), insert;—
(7) Where, pursuant to subsection (6), payment of a con tribution, or any part thereof, is deferred, interest on the amount so deferred, at such rate as the Treasurer may approve, shall be credited to the Renewal Reserve Account and debited to the Working Account.
(4) Fourth Schedule—
After the Third Schedule, insert:—

(Sec. 4.)
Works the care and management of which are divested from the
Administrator of the Junee Water Supply.
All works of which the management and control vest in or belong to the Administrator consequent upon the enactment of the Junee Water Supply Administration (Repeal) Act, 1982.
