HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the South-west Tablelands Water Supply Administration Act 1941, has been pleased to make the Regulation set forth hereunder.

Citation

l. This Regulation may be cited as the South-west Tablelands Water

Supply Administration (Price of Water) Regulation 1994.

Commencement

2. This Regulation commences on 1 September 1994.

Definitions

3. In this Regulation:

“the Act” means the South-west Tablelands Water Supply

Administration Act 1941;

“water supply authority” means a council or an electricity distributor within the meaning of the Electricity Act 1945 exercising the water supply functions of a council.

Price of water: prescribed rate

4. (1) For the purposes of section 8A of the Act, the rate at which the price of water supplied to a water supply authority by the Administrator during 1994 or any subsequent year is to be calculated is:

(a)	$6.63 per kilolitre for the first Q kilolitres of water supplied during that year; and
(b)	$0.515 per kilolitre for each kilolitre of water supplied during that year in excess of the first Q kilolitres; and
(c)	$0.515 per kilolitre for each kilolitre of water supplied during any week in that year in excess of the first Q kilolitres supplied during that week.

(2) For the purposes of the calculation under subclause (1), “Q”

represents the following amounts:

(a) 50,000 for Cootamundra Council;
(b) 39,000 for Harden Council;
(c) 192,000 for Northern Riverina Electricity;
(d) 3,100 for Southern Riverina Electricity;

(e) 68,000 for Young Council.

Price of water: minimum amount

5. For the purposes of section 8A of the Act, the minimum amount to be paid by a water supply authority for water supplied to it by the Administrator during 1994 or any subsequent year is:

(a) $331,500 for Cootamundra Council;
(b) $258,570 for Harden Council;
(c) $1,272,960 for Northern Riverina Electricity;
(d) $20,553 for Southern Riverina Electricity;

(e) $450,840 for Young Council.

Repeal

6. The South-west Tablelands Water Supply Administration (Price of

Water) Regulation 1983 is repealed.

EXPLANATORY NOTE

The object of this Regulation is to repeal and remake, without any changes in substance, the provisions of the South-west Tablelands Water Supply Administration (Price of Water) Regulation 1983. The new Regulation prescribes the rate at which the price of water supplied by the Administrator of the South-west Tablelands Water Supply is to be calculated and fixes minimum amounts for water so supplied. The actual rates and minimum amounts remain unchanged.

This Regulation is made under the South-west Tablelands Water Supply Administration Act 1941, .including section 20 (the general regulation making power) and section 8A.

This Regulation is made in connection with the staged repeal of subordinate legislation under the Subordinate Legislation Act 1989.
