His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the South-west Tablelands Water

Supply Administration Act 1941.

Explanatory note
The object of this Regulation is to alter:

(a)	the rate at which water from the South-west Tablelands Water Supply works supplied to councils, and to electricity distributors exercising water supply functions, is chargeable, and
(b)	the minimum amount payable by those councils and electricity distributors for water supplied to them.

The alterations will increase the price of water in line with increases in the Consumer Price Index. The Regulation has effect in relation to water supplied in 1997 and each subsequent year.

This Regulation is made under the South-west Tablelands Water Supply Administration Act 1941, including section 8A and section 20 (the general regulation making power).

1 Name of Regulation

This Regulation is the South-west Tablelands Water Supply Administration (Price of Water) Amendment Regulation 1996.

2 Commencement

This Regulation commences on 1 January 1997.

3 Amendment of South-west Tablelands Water Supply

Administration (Price of Water) Regulation 1994

The South- west Tablelands Water Supply Administration (Price of Water) Regulation 1994 is amended as set out in Schedule l .

[1]       Clause 4 Price of water: prescribed rate

Omit clause 4 (1). Insert instead:

(I)

For the purposes of section 8A of the Act, the rate at which the price of water supplied to a water supply authority by the Administrator during 1997 or any subsequent year is to be calculated is:

(a)	$7.067 per kilolitre for the first Q kilolitres of water supplied during that year, and
(b)	$0.549 per kilolitre for each kilolitre of water supplied during that year in excess of the first Q kilolitres, and
(c)	$0.549 per kilolitre for each kilolitre of water supplied during any week in that year in excess of the first Q kilolitres supplied during that week.

5 Price of water: minimum amount

For the purposes of section 8A of the Act, the minimum amount to be paid by a water supply authority for water supplied to it by the Administrator during 1997 or any subsequent year is:

(a)	$353,350 for Cootamundra Council,
(b)	$275,613 for Harden Council,
(c)	$1,356,864 for Riverina Water North (forming part of Great Southern Energy) in relation to the functions previously exercised by the former Northern Riverina Electricity,
(d)	$21,908 for Riverina Water South (forming part of Great Southern Energy) in relation to the functions previously exercised by the former Southern Riverina Electricity,
(e)	$480,556 for Young Council.
