SOUTH-WEST TABLELANDS WATER SUPPLY ADMINISTRATION ACT 1941—REGULATION

(Relating to the price of water)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the South-west Tablelands Water Supply Administration Act 1941, has been pleased to make the Regulation set forth hereunder.

The South-west Tablelands Water Supply Administration (Price of

Water) Regulation 1983 is amended:

(a) by inserting after clause 1 the following clause:

Definition

1A. In this Regulation:

“council” includes an electricity distributor exercising water

supply functions because of clause 7 of Schedule 11 to the

Electricity Act 1945.

(b) by inserting after clause 4 the following clause:

Price of water for 1994

5. (1) The price of water to be paid by a council for water supplied to the council by the Administrator in the year commencing on 1 January 1994 is to be the amount calculated at the following rate:

$6.63 per kilolitre for the first Q kilolitres of water supplied

during that year and $0.515 per kilolitre for each kilolitre supplied in excess of the first Q kilolitres supplied, plus an additional $0.515 per kilolitre for each kilolitre supplied

during a week in excess of the first Q kilolitres supplied
during that week.

(2) For the purposes of the calculation under subclause (1),

“Q” is:

• 192,000 for Northern Riverina Electricity

• 50,000 for Cootamundra Council
• 68,000 for Young Council

• 39,000 for Harden Council

• 3,100 for Southern Riverina Electricity.

(3) The minimum amount to be paid by a council for water supplied to the council by the Administrator in the year commencing on 1 January 1994 is:

• $1,272,960 for Northern Riverina Electricity

• $331,500 for Cootamundra Council

• $450,840 for Young Council • $258,570 for Harden Council • $20,553 for Southern Riverina Electricity.

EXPLANATORY NOTE

The object of this Regulation is to alter the rate at which water from the South-west Tablelands Water Supply works supplied to councils and electricity distributors exercising water supply functions is chargeable and to alter the minimum amount payable by the councils and electricity distributors for water supplied to them.

The Electricity (Savings, Transitional and Machinery Provisions) Regulation 1993 enables such electricity distributors to be treated in the same way as councils and county councils exercising water supply functions.

This Regulation is made under the South-west Tablelands Water Supply Administration Act 1941, including section 8A and section 20 (the general regulation making power).
