HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the South-west Tablelands Water Supply Administration Act 1941, has been pleased to make the Regulation set forth hereunder.

Commencement
l. This Regulation commences on 1 January 1996*.
Amendments
2. The South-west Tablelands Water Supply Administration (Price of
Water) Regulation 1994 is amended:
(a) by omitting clause 4 (1) and by inserting instead the following subclause: (1) For the purposes of section 8A of the Act, the rate at which the price of water supplied to a water supply authority by the Administrator during 1996 or any subsequent year is to be calculated is:
(a)
$6.928 per kilolitre for the first Q kilolitres of water supplied during that year; and

The regulation (statutory rule) appointed 1 January 1996 as the date of its commencement. Pursuant to section 39 (2A) of the Interpretation Act 1987. the regulation is not invalid merely because the regulation was published in the Gazette after the day on which one or more of its provisions is or are expressed to take effect, but provides, in that case, for that or those provisions to take effect from the day on which the regulation is published in the Gazette. instead of from the earlier day.
(b)
$0.538 per kilolitre for each kilolitre of water supplied during that year in excess of the first Q kilolitres; and
(c)
$0.538 per kilolitre for each kilolitre of water supplied during any week in that year in excess of the first Q kilolitres supplied during that week.

Price of water: minimum amount
5. For the purposes of section 8A of the Act, the minimum
amount to be paid by a water supply authority for water supplied
to it by the Administrator during 1996 or any subsequent year is:(a) $346,400 for Cootamundra Council;
(b) $270,192 for Harden Council;
(c)
$1,330,176 for Energy South (in relation to the functions previously exercised by the former Northern Riverina Electricity);
(d)
$21,477 for Energy South (in relation to the functions previously exercised by the former Southern Riverina Electricity);
(e) $471,104 for Young Council.
EXPLANATORY NOTE
The object of this Regulation is to alter the rate at which water from the South-west Tablelands Water supply works supplied to councils and electricity distributors exercising water supply functions is chargeable and to alter the minimum amount payable by the councils and electricity distributors for water supplied to them. The alterations will increase the price of water in line with increases in the Consumer Price Index. The Regulation has effect in relation to water supplied in 1996 and each subsequent year.
This Regulation is made under the South-west Tablelands Water Supply Administration Act 1941, including section 20 (the general regulation making power) and section 8A.
