GAUDRON J: This case was heard in Hobart on 1 and 2 April 1998 by a Court constituted by Justices McHugh, Kirby, Hayne, Callinan and myself. On 2 April 1998, the Court dismissed the applications for special leave to appeal and reserved the question of costs.
