GAUDRON J:   This case was heard in Hobart on 1 and 2 April 1998 by a Court constituted by Justices McHugh, Kirby, Hayne, Callinan and myself.  On 2 April 1998, the Court dismissed the applications for special leave to appeal and reserved the question of costs.  Justices McHugh, Hayne, Callinan and I would order that, in each application, the applicant pay the respondent’s costs of the application and I publish our joint reasons.
