[1] Further to the mention of this matter on 29 January 2010, I have received correspondence dated 10 February 2010 from the applicant’s representative, the Baking Industry Association (NSW Employers), which relevantly reads:
… acknowledging the issues raised by Fair Work Australia, we wish to withdraw this application for an enterprise agreement.
[2] In the circumstances, I note the application has been withdrawn and that the further listing of the matter on 15 February 2010 has been vacated.
[3] The proceedings are concluded accordingly.
