An Act to close a portion of a road in South Melbourne and for other purposes.

Preamble

WHEREAS—

(a)the land delineated and shown hatched on the Plan in the Schedule is part of a road in the City of South Melbourne known as Bright-street; and

(b)it is expedient that that part of the road be closed:

BE IT ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title

This Act may be cited as the South Melbourne Land Act 1985.

2.Commencement

This Act shall come into operation on a day to be fixed by proclamation of the Governor in Council published in the Government Gazette.

3.Closure of portion of Bright Street

(1)The land delineated and shown hatched on the plan in the Schedule shall be closed as a road and all rights, easements and privileges existing or claimed either in the public or by any body or person whatsoever or whomsoever as incident to any past dedication or supposed dedication thereof or by user thereof or by any fiction of law shall cease and determine and the said land shall be deemed to be and may be dealt with as unalienated land of the Crown.

(2)The Registrar-General and the Registrar of Titles are hereby authorized and directed to make all such entries or endorsements on any certificate of title and the duplicate thereof on any conveyance or on any other document as may be necessary or expedient in consequence of this section and the holder of the duplicate certificate of title or other document shall produce it to the Registrar-General or the Registrar of Titles (as the case may be) for that purpose.

4.No compensation payable by Crown

No compensation shall be payable by the Crown in respect of any act, matter or thing done under or arising out of this Act.
