[ASSENTED TO 23RD SEPTEMBER, 1937.] B E it enacted by the King's JYIost Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART 1.- PRELIMINARY. PART I.-PRELIMINARY. Short title 1. OF 1927." Collective Amendments of the Principal Act. title. 4. A new paragraph (dl) is inserted after paragraph Amendment (d) of section four of the Principal Act, as follows :_ of s. 4. "(dl) Notwithstanding anything to the contrary Reduction contained • in this Act, the amount of the .indebtedness p of a a y n m nu e a n tsl i . ll outstandmg on the first day of January, one thousand respect of nine hundred and thirty-seven, in respect of the liability? ~ S~ uth to the Treasurer taken over by the association in respect s~ : one of such sugar works (which amount is hereby declared Works. to be the sum of two hundred and six thousand six hundred and fifty-eight pounds four shillings and four pence,) shall, in lieu of being liquidated in the manner hereinbefore provided in paragraph (d) of this section, be liquidated as follows, that is to say:- The amount of such liability so outstanding on the first day of January, one thousand nine hundred and thirty-seven (being the aforesaid sum of two hundred and six thousand six hundred and fifty-eight pounds four shillings and four pence) shall be deemed a loan by the Treasurer to the association from the first day of January, one thousand nine h.undred and thirty-seven, and shall bear interest at the rate of four pounds per cent. per annum, and such liability, with interest as aforesaid, shall be liquidated by the pay- ment by the association to the Treasurer on the thirty-first day of December in every year commencing with the year one thousand nine hundred and thirty-seven of the sum of thirty thousand pounds, and such sums shall continue to be payable by the association to the Treasurer until the said liability, with interest at the aforesaid rate accruing thereon, has been extinguished." 5.A new paragraph (bJ) is inserted after paragraph Amendment (b) of section five of the Principal Act, as follows :_ oh. 11. ~ ' ( bl) Notwithstanding anything to the contrary contained in this Act, the amount of the indebtedness outstanding on the first day of January, one thousand

' ~ sum hereinafter respectively set forth) shall, in lieu of being liquidated in the manner respectively hereinbefore provided in paragraph (b) of this section, be respectively liquidated as follows, that is t9 say : - Reduction of annual payments in respect of the Gin Gin Sugar Works. (i.) In respect of the Gin Gin Co-operative Sugar Milling Association Limited, the amount of such liability so outstanding on the first day of January, one thousand nine hundred and thirty-seven (being the sum of fifteen thousand eight hundred and fifty-four pounds nineteen shillings and nine pence) shall be deemed to be a loan from the Treasurer to the said association from the first day of J anuary ~ one thousand nine hundred and thirty- seven~ and shall bear interest at the rate of four pounds per cent. per annum, and such liability, wi~ h interest as aforesaid, shall be liquidated by the payment by the said association to the Treasurer on the thirty-first day of December in every' year commencing with the year one thousand nine hundred and thirty-seven of the sum of one thousand five hundred pounds, and such sums shall continue to be payable until thesaidliability~ with interest at the aforesaid rate accruing thereon, has been extinguished; Reduction of annual payments in respect of .the North Eton Sugar Works. (it".) In respect of the North Eton Co-operative Sugar Milling Association Limited, the amount of such liability so outstanding on the first day of January, one thousand nine hundred and thirty-seven (being the sum of twenty-nine thousand nine hundred and fifty-five pounds seven shillings and two pence) shall be deemed to be a loan from the Treasurer to the said association from the first day of January, one thousand nine hundred and thirty-seven, and shall bear interest at the rate of four pounds per cent. per annum, and such liability, with interest as afore.aaid, shall be liquidated by the payment by the said association to the Treasurer ~n the thirty-first day of December in every year commencing

The Order in Council made the eighteenth day ET~ " , AND of June, one thousand nine hundred and thirty-one, and : BAUPL~ US~ GAR published in the Government Gazette of the twentieth day , ": , ~ R~ ~ 27~ ? T of June, one thousand nine hundred and thirty-one, Reduotion whereby the provisions of the Principal Act set out in - poafyamnneunatls in the Schedule thereto, as modified and added to as respeot of appearing in such Schedule, were extended to the Proser- Pthreoserpine pine Sugar Works is hereby further modified an<i added to :Sugar by the extension to the said the Proserpine Sugar Works Works. of the following provision (being a provision inserted in the Principal Act by this Act) and to the intent that the following paragraph, ·numbered (iva.), is hereby inserted in the Schedule of the said Order in Council after paragraph (iv.) of clause two thereof, namely:- " (iva.) Notwithstanding anything to the contrary contained in this Order in Council, the amount of the indebtedness outstanding on the first day of January, one thousand nine hundred and thirty-seven, in respect of the liability to the Treasurer taken over by the associa- tion in respect of such sugar works (which amount is hereby declared to be the sum of seventy-two thousand two hundred and seventy-eight pounds seven shillings and eight pence) shall, in lieu of being liquidated in the manner hereinbefore provided in paragraph (iv.) of this clause, be liquidated as follows, that is to say : - The amount of such liability so outstanding on the first day of January, one thousand nine hundred and thirty-seven (being the aforesaid sum of seventy-two thousand two hundred and seventy-eight pounds seven shillings and eight pence) shall be deemed to be a loan from the Treasurer to the association from the first day of January, one thousand nine hundred and thirty-seven, and shall bear interest at the rate of four pounds per cent. per annum, and such liability, with interest as aforesaid, shall be liquidated by the payment by the association to the Treasurer on the thirty-first day of December in each year commencing with the year one thousand nine hundred and thirty-seven of the sum of seven thousand pounds, and such sums shall continue to be payable by the associa- . tion to the Treasurer until the said liability, with interest at the aforesaid rate accruing thereon, has been extinguished."

A new subsection 5A is inserted after subsection Amendment five of section four of the Principal Act, as follows :_ of B. 4. " (5A.) Notwithstanding anything to the contrary Reduction contained in this Act, the amount of the indebtedness of a: : ~ ~ ~ in # outstanding on the first day of January, one thousand ~ : ~ ect of nine hundred and thirty-seven, in respec~ o~ th~ liability ~ ~~ ! ullY to the Treasurer taken over by the assoCIatIOn III respect Works. of such sugar works (which amount is hereby declared to be the sum of three hundred and sixty-nine thousand three hundred and eighteen pounds four shillings and three pence) shall, in lieu of being liquidated in the manner hereinbefore provided in subsection five of this section, be liquidated as follows, that is to say:- The amount of such liability so outstanding on the first day of January, one thousand nine hundred and thirty-seven (being the aforesaid sum of three hundred and ~ ixty- nine thousand three hundred and eighteen pounds four shillings and three pence) shall be deemed a. loan by the Treasurer to the association from the first day of January, one thousand nine hundred and thirty-seven, and shall bear interest at the rate of four and a-half pounds per cent. per annum, and such liability, together with interest as aforesaid, shall be liquidated by the payment by the association to the Treasurer on the thirty-first day of December in every year commencing with the year one thousand nine hundred and thirty-seven of the sum of forty thousand pounds, and such sums shall continue to be * 21 Geo. IV.-SUBSEQUEN1' VARIATION IN THE RATE OF INTEREST AND/OR ANNUAL INSTALMENTS. Variation. ·9. Notwithstanding anything in this Act or in any Act mentioned in this Act or in any other Act contained, the Governor in Council may at any time and from time to time by Order in Council published in the Gazette vary, whether by way of increase or decrease, the annual rate of interest and/or the annual instalments of interest and redemption payable by all or any of the said associations hereinbefore mentioned in this Act in respect of the respective liabilities to the Treasurer taken over and assumed by all or any of the said associa- tions under and in pursuance of the Acts referred· to in Parts H. and HI. of this Act, and this Act and every such Order in Council made under the authority of this section shall have the same force and effect as if the same were enacted in this Act and shall be judicially noticed and shall not be questioned in any proceedings whatsoever. . PART V.- RATICATION OF PREVIOUS REDUCTIONS. PART V.-RATIFICATION OF PREVIOUS REDUCTIONS. Ratification. 10. Any reduction made by the Treasurer prior to the passing of this Act in the annual rates of interest and/or in the annual instalments of interest and redemp- tion payable by the several asso.ciations hereinbefore mentioned in respect of the respective liabilities to the Treasurer taken over and assumed by them under and in pursuance of the Acts referred to in Parts H. and HI. of this Act is hereby approved, ratified, confirmed, and validated.
