B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :— 1.(1.) This Act may be cited as " The South Short title. Brisbane Gas and Light Company (Limited) Act Amendment Act of 1958." Section thirty-seven of the Principal Act is A.fin.e. tients amended— (a) By repealing therein all words assigning a meaning to the words "Local Authority" and inserting, in lieu of the words so repealed, the words "The words "Local Authority" shall mean Brisbane City Council under and within the meaning of t" The City of Brisbane Acts, 1924 to 1958." (b) By adding thereto the following paragraph "References in this Act to "municipality or division ", however expressed, shall be taken to refer to Brisbane City Council." New as. 37A 3. The following sections are inserted after section ainnsde3rt7eBd. thirty-seven of the Principal Act, namely :— "[37A.] Nothing in this Act or in the memorandum and articles of association of The South Brisbane Gas and Light Company, Limited, shall authorise, or be deemed to authorise, that company to supply gas, or to exercise any of the powers conferred upon it by sections nine, ten, eleven, twelve and thirteen of this Act, outside the Area set out in the Schedule to this Act. Powers of [37B.] (1.) Subject to this section, the Governor CGoouvnecrnilo. r in in Council may from time to time, by Order in Council published in the Gazette, amend the Schedule to this Act— (a) By excluding from the Area set out therein any part of that Area; or (b) By including in the Area set out therein any other area not already included in that Area, and the said Schedule as so amended shall thereupon become for the time being the Schedule to this Act and shall have effect accordingly. (2.) The Governor in Council shall not, pursuant to this section, exclude from the Area set out in the Schedule to this Act any part of that Area, or include in that Area any area not already included therein, save with the prior consent in writing of The South Brisbane Gas and Light Company, Limited. (3.) The Governor in Council shall not, pursuant to this section, include in the Area set out in the Schedule to this Act any area not already included therein wherein any person or company other than The South Brisbane Gas and Light Company, Limited is authorised under an Act to supply gas save with the prior consent in writing of that person or company. For the purposes of this subsection a company or person shall be deemed to be not authorised by an Act to supply gas in an area which is not expressly set out in the Act in question."
