1—Short title
These regulations may be cited as the South Australian Country Arts Trust Regulations 1992.
2—Commencement
(1)Subject to subregulation (2), these regulations will come into operation on 26 November 1992.
(2)Regulation 3 will come into operation on 1 January 1993.
3—Revocation
All regulations made under the Cultural Trusts Act 1976 are revoked.
4—Interpretation
In these regulations, unless the contrary intention appears—
the Act means the South Australian Country Arts Trust Act 1992.
5—Membership of Country Arts Boards—nominations
(1)For the purposes of section 21(1)(c) of the Act—
(a)a person may nominate himself or herself or another person for appointment as a member of a Country Arts Board;
(b)a body that, at the commencement of this regulation, held group membership of a Cultural Trust under the Cultural Trusts (Subscribers) Regulations 1989 may nominate persons for appointment as members of a Country Arts Board the area of which most closely corresponds to the area of the Cultural Trust for which the body held group membership;
(c)the Central Region Cultural Authority Incorporated may nominate persons for appointment as members of the Central Country Arts Board.
(3)The application of subregulation (1)(b) extends to a body with a membership wholly or partly of persons resident in Victoria in any of the local government areas specified below, being a body that, at the commencement of this regulation, held group membership of the South East Cultural Trust:
Shire of Dundas
Shire of Glenelg
Shire of Haywood
Shire of Kowrie.
(4)For the purposes of section 21(2)(b) of the Act, a person is eligible for nomination as a member of the South East Country Arts Board if the person is resident in Victoria in any of the local government areas specified in subregulation (3).
(5)Where it is necessary to call for the nomination of persons for appointment as members of a Country Arts Board, the Minister must do so by notice published in a newspaper circulating throughout the area of the Board.
(6)A notice under subregulation (5) must—
(a)specify—
(i)the number of persons to be appointed; and
(ii)the requirements of subregulation (8) in relation to a nomination; and
(iii)the date and hour by which and the address at which nominations must be lodged; and
(b)state that, if the nominator so wishes, the nomination may specify the nature of the nominator's interest in the arts.
(7)The date for the closure of nominations must be at least 14 days after the date of publication of the notice.
(8)A nomination must—
(a)be in writing; and
(b)—
(i)where the nominator is a natural person—
(A)be signed by the nominator; and
(B)state the full name and principal place of residence of the nominator;
(ii)where the nominator is a body—
(A)be signed by a person duly authorised by the body to sign the nomination on its behalf; and
(B)state the full name of the body; and
(C)state the full name and residential address of the person signing the nomination on behalf of the body; and
(c)state the full name and principal place of residence of the nominee; and
(d)where the nominator is not also the nominee—contain a statement signed by the nominee to the effect that he or she is willing to be appointed; and
(e)be lodged not later than the hour specified in the notice for the closure of nominations.

Revocation of regulations
The South Australian Country Arts Trust Regulations 1992 were revoked by Sch 1 of the South Australian Country Arts Trust Regulations 2004 on 1.9.2004.
