An extension of time is required for this application to proceed. The application for special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of Victoria (Kyrou and Sifris JJA) has no prospects of success. There is no reason to doubt the correctness of the decision of the Court of Appeal. Nor is there any basis to conclude that the applicant was denied procedural fairness by the Court of Appeal or that the hearing or orders of the Court of Appeal involved any error or miscarriage of justice on any of the grounds asserted by the applicant. It would therefore be futile to grant an extension of time. The application should be dismissed.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
