  1. The applicant requires an extension of time within which to seek special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of South Australia (Doyle JA, Blue and Kimber A-JJA) which granted permission to appeal but dismissed an appeal against convictions for rape following a trial by Judge alone in the District Court of South Australia (Judge Muscat).

  2. There is no reason to doubt the correctness of the unanimous decision of the Court of Appeal. The proposed grounds of appeal lack sufficient prospects of success to warrant the grant of special leave to appeal. Accordingly, it would be futile to grant the extension of time.

  3. Special leave to appeal is refused.
