CaseChat Overview and Summary
The central legal issue was whether the agreement could be certified as a single-employer agreement. This required consideration of the relationship between the parties and whether the negotiation process was genuine. The court had to determine if the agreement genuinely reflected the terms of employment across the various sites.
The Commission found that the negotiation process was genuine and the agreement appropriately reflected the terms of employment across the sites. It concluded that the negotiation process was conducted in good faith and that the agreement should be certified as a single-employer agreement. The Commission took into account the nature of the work and the commonality of the employment conditions across the different sites.
As a result, the Fair Work Commission certified the Sodexo MUA Enterprise Agreement 2012 as a single-employer agreement, effective from the date of the decision. The agreement was approved, and the applicant was authorised to implement the terms of the agreement.
