Social Services Amendment Regulations 2024

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Social Services Regulations 2023—

(a)to amend the services prescribed to be WCES services for the purposes of the Social Services Regulation Act 2021; and

(b)to amend the providers prescribed to be WCES service providers for the purposes of that Act; and

(c)to amend the circumstances in which an application for removal of information relating to a person from the WCES database may be made.

2Authorising provision

These Regulations are made under section 316 of the Social Services Regulation Act 2021.

3Regulation 38 substituted

For regulation 38 of the Social Services Regulations 2023[1] substitute—

"38   WCES services

For the purpose of the definition of WCES service in section 3(1) of the Act, the worker and carer exclusion scheme is prescribed to apply to the following services—

(a)providing foster care to a child;

(b)caring for children in an out of home care residence managed by an out of home care service;

(c)services provided to children at an out of home care residence managed by an out of home care service by a person employed or engaged by that out of home care service;

(d)caring for children at a secure welfare service;

(e)services provided to children at a secure welfare service by a person employed or engaged by that secure welfare service.".

4WCES service providers

In regulation 39 of the Social Services Regulations 2023, for "a body" substitute "a registered social service provider".

5Application for removal of exclusion from database

In regulation 43(1)(a)(i) of the Social Services Regulations 2023, before "at least 12 months" insert "unless exceptional circumstances exist,".
