I, BRENDAN JOHN NELSON, Minister for Education, Science and Training, make this Determination under section 35A of the Social Security Act 1991.[1]

[1] This instrument has effect in relation to provisions of the Social Security Act 1991 in so far as they relate to matters for which the Department of Education, Science and Training has responsibility under the Administrative Arrangements Order made on 16 December 2004

1.   Name of determination

This determination is the Social Security (Victorian Transport Accident Commission ‘Attendant Care Service’ and ‘Post Acute Support’ Exemption) (DEST) Determination 2005.

2.   Commencement

This determination commences on 1 September 2005.

3.   Personal care support schemes

I determine that the schemes for the provision of personal care support known as Attendant Care Service and Post Acute Support (being the schemes of that name established by the Victorian Transport Commission under the Transport Accident Act 1986 (Vic) under which an allowance for long term and temporary care is paid to certain injured persons) are approved schemes for the purposes of the Social Security Act 1991.
