I, BRENDAN JOHN NELSON, Minister for Education, Science and Training, make this Determination under section 35A of the Social Security Act 1991[1].

[1] This instrument has effect in relation to provisions of the Social Security Act 1991 in so far as they relate to matters for which the Department of Education, Science and Training has responsibility under the Administrative Arrangements Order made on 16 December 2004

1.   Name of determination

This determination is the Social Security (Tasmanian Motor Accidents Insurance Board ‘Future Care Payments’ Exemption) (DEST) Determination 2005.

2.   Commencement

This determination commences on 1 September 2005.

3.   Personal care support scheme

I determine that the scheme for the provision of personal care support known as Future Care Payments (being the scheme of that name established by the Tasmanian Motor Accidents Insurance Board under the Motor Accidents (Liabilities and Compensation) Act 1973 (Tas) under which an allowance for long term care is paid to certain injured persons) is an approved scheme for the purposes of the Social Security Act 1991.
