Part 1    Preliminary

1.         Name of declaration

This declaration is the Social Security (Specified Class of Persons in Australia in Specified Circumstances—Health Care Card) Declaration 2018 (the declaration).

2.         Commencement

  1. Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3.         Authority

This declaration is made under subsection 1061ZO(7) of the Social Security Act 1991.

4.         Interpretation

Act means the Social Security Act 1991;

Health care card income test has the meaning given by section 1071A of the Act.

Part 2        Specified class of persons in Australia in specified circumstances

5.         Qualification for a health care card

(1)        A person who is the holder of any of a:

(a)subclass 060 (Bridging F) visa;

(b)subclass 070 (Bridging (Removal Pending)) visa;

(c)subclass 309 (Partner (Provisional)) visa;

(d)subclass 449 (Humanitarian Stay (Temporary)) visa;

(e)subclass 785 (Temporary Protection) visa;

(f)subclass 786 ((Temporary) Humanitarian Concern) visa;

(g)subclass 790 (Safe Haven Enterprise) visa;

(h)subclass 820 (Partner) visa; and

(2)        satisfies the health care card income test; and

(3)        is, or has been, in Australia as the holder of a relevant visa

is declared to be a person to whom section 1061ZO of the Act applies.
