1  Name

This instrument is the Social Security (Special Disability Trust – Discretionary Spending) Determination 2023.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subsection 1209RA(3) of the Social Security Act 1991.

4  Definitions

Note:          A number of expressions used in this instrument are defined in definitions section of the Act, including the following:

(a)   special disability trust

(b)     principal beneficiary

In this instrument:

Act means the Social Security Act 1991.  

5  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

6  Trust expenditure requirements

For subsection 1209RA(3) of the Act, the amount of $14,000 is determined to be the total value of income and assets of a special disability trust that may be applied for the 2023-2024 financial year for purposes, other than the primary purpose described in subsection 1209N(1) of the Act, that are primarily for the benefit of the principal beneficiary of the trust.
