1  Name of regulation

                  This regulation is the Social Security Regulation 2012.

3  Definitions

                  In this regulation:

Act means the Social Security Act 1991.

family member has the same meaning as in subsection 23 (14) of the Act.

4  Meaning of humanitarian purpose

                  For paragraph 1212B (c) of the Act, a purpose is the following:

                    (a)  attendance, as a formally selected member of the Australian Paralympic Team, for participation as a competitor, at the international athletic competition known as the Paralympic Games;

                   (aa)  attendance, within the 12‑month period before the international athletic competition known as the Paralympic Games, by a person receiving a disability support pension for participation, as an athlete at an athletic competition or other event, if:

                             (i)  that attendance is necessary to qualify as a competitor at the Paralympic Games; or

                            (ii)  that attendance is necessary to prepare as a competitor for the Paralympic Games (whether or not the person has qualified as such a competitor);

                    (b)  attendance, at a memorial service that has been approved by the Australian Government to commemorate an event involving the death or serious injury of an Australian resident, as one of the following persons:

                             (i)  an Australian resident who was seriously injured in the event;

                            (ii)  a family member of an Australian resident who died or was seriously injured in the event.

Examples of an event

A war, an act of terrorism, a natural disaster.

6  Application—amendments made by the Social Security Amendment Regulation 2016 (No. 1)

                  The amendment made by item 1 of the Social Security Amendment Regulation 2016 (No. 1) applies in relation to:

                    (a)  the Paralympic Games to be held in Rio de Janeiro, Brazil in September 2016; and

                    (b)  future Paralympic Games.

Editorial changes

The Legislation Act 2003 authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.

Misdescribed amendments

A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.

If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.
