Social Security (Pension Bonus Scheme  —  Non-accruing Members – Major Disaster) Declaration 2006

I, Dr Jeff Harmer, Secretary of the Department of Families, Community Services and Indigenous Affairs, make this Declaration under subsection 92Q(1) of the Social Security Act 1991.

1. Name of Declaration

This Declaration is the Social Security (Pension Bonus Scheme  –  Non‑accruing Members – Major Disaster) Declaration 2006.

1. Commencement

This Declaration commences on the day after it is registered.

Note Section 56 of the Legislative Instruments Act 2003 provides that the requirement, under subsection 92Q(1) of the Social Security Act 1991, for publication in the Gazette is satisfied if the instrument is registered.

1. Definitions

In this Declaration:

Act means the Social Security Act 1991.

Note         The following expressions used in this Declaration are defined in the Act (see s 4, 23 and 36):

§Veterans’ Entitlements Act

1. Kinds of non-accruing members

A member of the Pension Bonus Scheme, who is a member of any of the following kinds, is a non-accruing member of the Pension Bonus Scheme, for the purposes of Subdivision B, Division 3, Part 2.2A of the Act, for the period specified in section 6:

(a)   a member whose amount of gainful work has been reduced by the occurrence of a Major Disaster; or

(b)   a member whose partner:

(i)is a member of:

(A)the Pension Bonus Scheme; or

(B)the corresponding scheme under Part IIIAB of the Veterans’ Entitlements Act; and

(ii)has had their gainful work reduced by the occurrence of a Major Disaster.

1. Request by member to remain as an accruing member

Section 4 does not apply if a member of the Pension Bonus Scheme requests that this Declaration does not apply to them for all, or part, of the period.

1. Period for which member is a non-accruing member

A member of the Pension Bonus Scheme who is a member of the kind described in paragraph 4(a) or 4(b) is a non‑accruing member throughout the period during which the member is a member of the kind specified in section 4, up to a maximum of 13 weeks from the occurrence of the Major Disaster.
